User Service Agreement

1Agreement Acceptance and Validity

This User Service Agreement (hereinafter "this Agreement") is entered into between you (hereinafter "User" or "you") and MacLogin (hereinafter "we," "us," or "the Platform") and is legally binding on both parties.

You are deemed to have fully read, understood, and accepted all terms of this Agreement by any of the following means:

  • Clicking "Agree", "Confirm", or similar buttons on registration, login, or checkout pages;
  • Accessing, browsing, or using any service provided by the Platform in any manner;
  • Completing the account registration process.

If you do not agree to any term of this agreement, please immediately stop using all services. Minors are not permitted to register or use this service.

2Service Description

MacLogin provides users with cloud server rental and related services based on Apple Silicon (Mac Mini M4) hardware, including but not limited to:

  • Dedicated physical server rental (billed daily / weekly / monthly / quarterly)
  • SSH remote terminal access
  • VNC graphical remote desktop
  • Network connectivity and bandwidth resources
  • Basic technical support services

We reserve the right to adjust, add, or discontinue certain service features at any time without prior notice to users and without any liability for such changes. The final form of the service is determined by what the Platform actually provides.

3Account Registration and Security

3.1 Registration Requirements

You must provide true, accurate, and complete registration information and keep it up to date. Any consequences arising from false information are solely your responsibility. Each user may only register and hold one account.

3.2 Account Security

You are responsible for safeguarding your account password and login credentials. All actions performed under your account are deemed to be your own, and you bear corresponding legal responsibility. If you discover unauthorized access to your account, please notify us immediately via a support ticket; however, we are not responsible for actions that occurred before the unauthorized access was reported.

3.3 Account Transfer Restrictions

Without our written consent, you may not transfer, lend, lease, or otherwise make your account or account-related rights available to any third party in any form. Violators may have their accounts immediately suspended with no refund of paid fees.

4Usage Policies and Prohibited Activities

You agree to use the service solely for lawful purposes and to comply with all applicable laws and regulations. The following activities are strictly prohibited; violators will have their accounts immediately suspended with no refund of paid fees:

  • Engaging in activities that violate the laws and regulations of any country or region
  • Launching network attacks, DDoS attacks, port scanning, or intruding into others' systems
  • Sending spam or conducting phishing
  • Distributing malware, viruses, ransomware, or similar harmful programs
  • Conducting unauthorized cryptocurrency mining
  • Operating proxy, VPN, or traffic relay services (without written authorization)
  • Infringing on the intellectual property rights, privacy rights, or other legal rights of third parties
  • Engaging in any activity that may damage the Platform's infrastructure, network stability, or other users' interests
  • Bypassing or attempting to bypass any security measures or technical restrictions of the Platform
We reserve the right to reasonably monitor account activity. For suspected violations, we may suspend services and commence an investigation without prior notice. Fees incurred during the investigation period continue to be charged as normal.

5Payments and Billing

5.1 Billing Description

All fees are denominated in USD and paid in advance before service begins. The billing cycle you select (daily / weekly / monthly / quarterly) cannot be changed to a shorter cycle once confirmed. All paid fees are non-refundable.

5.2 Auto-Renewal

Unless you disable auto-renewal in the console before the end of the current billing cycle, the service will automatically renew and be charged at the same billing cycle.

5.3 Price Adjustments

We reserve the right to adjust service pricing. Prices within existing subscription cycles are not affected; new prices take effect from the next billing cycle.

5.4 Taxes

All displayed prices exclude applicable taxes. You are solely responsible for all tax obligations arising from your use of this service.

6Service Level and Availability

6.1 Availability Target

We are committed to providing stable and reliable services, targeting a monthly network availability of 99.0% (excluding scheduled maintenance and force majeure events). This target represents a goal and does not constitute a legally binding service commitment.

6.2 Scheduled Maintenance

We will endeavor to provide advance notice of scheduled maintenance windows, but reserve the right to perform maintenance without notice in emergencies. Unavailability during maintenance periods is excluded from SLA calculations.

6.3 Resource Usage

Your server has defined resource specifications (CPU, memory, storage, bandwidth). If your usage unreasonably impacts shared network resources or other users, we reserve the right to restrict or suspend the relevant resource usage without further notice.

7Data and Backup Responsibility

Data backup is entirely the user's responsibility.We do not provide automatic backup services and accept no liability for data loss, corruption, or unrecoverability for any reason, including but not limited to:

  • Hardware failure or accidental damage
  • Data deletion following service termination or account suspension
  • Data loss caused by human error or software defects
  • Natural disasters or other force majeure events

After account expiry or termination, all data on the server will be permanently deleted within 72 hours and is unrecoverable. Please complete data migration before the service expires.

We strongly recommend regularly backing up important data to an independent external storage medium or another cloud service.

8Intellectual Property

All content on the MacLogin Platform, including but not limited to website design, interface elements, text, graphics, logos, software code, API interfaces, and documentation, is the exclusive property of MacLogin and is protected under Chinese and international intellectual property laws. Reproduction, modification, distribution, or creation of derivative works in any form without written authorization is prohibited.

You retain ownership of the content you store on your server. You grant us a limited, non-exclusive license necessary to process, transmit, and store your content during the provision of services.

You grant us the right to use your service usage data in an anonymized, aggregated manner for improving platform performance, conducting technical research, and optimizing services.

9Disclaimer

To the maximum extent permitted by law, MacLogin expressly disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We bear no liability for the following:

  • Service unavailability caused by general or partial internet outages or upstream carrier network interruptions
  • Service interruptions due to force majeure (including natural disasters, war, government controls, pandemics, etc.)
  • Failures or service changes by third-party providers (including payment processors and upstream network suppliers)
  • Hacking, network intrusions, or other malicious third-party actions
  • Data loss or system damage caused by the user's own improper operations
  • Any third-party claims arising from content you store on the server
  • Service suspension or termination due to compliance with lawful orders from government or judicial authorities

10Limitation of Liability

Under no circumstances shall MacLogin's total cumulative liability for all claims, losses, or damages arising under or related to this agreement exceed the service fees actually paid by you to us during the most recent calendar month prior to the disputed event.

MacLogin shall not be liable for any of the following types of losses, regardless of whether it has been advised of the possibility of such losses:

  • Indirect, incidental, special, or punitive damages
  • Loss of profits, business opportunities, goodwill, or data
  • Losses caused by business interruption

Some jurisdictions do not allow the limitation of liability for certain types of losses; in such cases, the above limitations apply only to the maximum extent permitted by law.

11Service Suspension and Termination

11.1 User-Initiated Termination

You may terminate the service at any time by disabling auto-renewal in the console. The service will stop at the end of the current billing cycle, and paid fees are non-refundable.

11.2 Platform Right to Terminate

We have the right to immediately suspend or permanently terminate your service in the following circumstances, without prior notice, and paid fees are non-refundable:

  • Violation of any prohibited activity in Section 4 of this Agreement
  • Overdue invoices unpaid for more than 72 hours
  • Account suspected of fraud or being used for illegal purposes
  • Compliance with legal requirements or lawful orders from law enforcement
  • User behavior causes significant impact on the Platform's infrastructure or other users

11.3 Data Deletion

After service termination, we will delete all server data associated with the account within 72 hours. This action is irreversible.

12Amendment of Terms

We reserve the right to modify this agreement at any time. Updated agreements will be published on this page with a revised "Last Updated" date. Your continued use of the service after the modification is published constitutes acceptance of the updated terms. If you do not accept the changes, you should stop using the service before the changes take effect; however, services already purchased within the current billing cycle remain governed by the terms before the modification.

13Dispute Resolution and Jurisdiction

13.1 Negotiation First

In the event of any dispute, both parties shall first attempt to resolve it through friendly negotiation. You may contact us via the ticket system, and we will respond within 5 business days.

13.2 Governing Law and Jurisdiction

The formation, validity, interpretation, and dispute resolution of this Agreement are governed by the laws of the People's Republic of China (excluding conflict-of-law rules). If negotiation fails, disputes shall be submitted to the competent People's Court at the location of the Platform's operating entity.

13.3 Severability

If any provision of this Agreement is found to be invalid or unenforceable, that provision will be modified to the minimum necessary extent, and the remaining provisions will continue in full force and effect.
